CMC may periodically update this Privacy Policy. If so, CMC will post the updated Privacy Policy on this Site. CMC encourages you to review this Privacy Policy from time to time for any changes.

By using this Site or any products or services provided through the Site, you expressly consent to the use and disclosure of information as described in this Privacy Policy. IF YOU DO NOT AGREE WITH ANY OF THE TERMS BELOW, YOU SHOULD NOT USE THIS SITE OR THE PRODUCTS OR SERVICES OFFERED BY CMC AT THIS SITE.

Explanation of Software and Services

CMC provides the CMC Software (“Software”) and manages operations of the CMC Services (“Services”). The Software can be downloaded for a free trial within a predetermined period of time. Upon expiry of the trial period, users may opt to continue using the Software by paying a subscription fee via our online payment facility. The Software may require registration in order to use certain Services provided via our Site. From time to time, new services may be added which improve, modify or extend the functionalities of the CMC Software.

Use of Information

CMC does not sell, rent, loan, trade, lease or otherwise transfer any personal information collected through CMC Software or Services to any third party outside the CMC network. We will treat any information you provide to CMC limited as confidential information and will not disclose it to any third party outside the CMC network. We will provide information collected through the network to other users in the network only with your explicit permission as granted by you through applicable settings available in the Software. This information is generally not stored by CMC at all and is instead voluntarily shared by users to and from other users in the network.

Generally, we use the information we gather for the following purposes:

  • To customize the advertising and content you see.

  • To enhance the user experience in our Site. We use tracking information to determine how well each page performs overall based on aggregate user demographics and traffic patterns to those pages. This helps us continue to build a better service for you.

  • To fulfill your requests for certain products and services, such as sending out electronic newsletters and enabling users to participate in paid services, polls, contests, promotions and message boards.

  • To send you information you agreed to receive about topics we think will be of interest to you.

Use of your Personal Information

You may decide whether to proceed with any activity that requests personally identifiable information. If you do not wish to provide the requested information, however, you may not be able to complete the transaction. We do not collect information from individuals under the age of 13. If you are under the age of 13, we ask that you do not submit any personal information through the Site. If we have specific knowledge that an individual under the age of 13 has submitted personally identifiable information to the Site, we will delete such information permanently and without notice.

Except as described below, CMC will only disclose your personally identifiable information to third parties if acting under a good faith belief that such action is necessary (1) to conform to legal requirements; (2) to protect and defend the rights or property of CMC; (3) to enforce the CMC Terms of Service; or (4) in the event of a merger, acquisition or sale of all or substantially all Charleston Management Centre’s assets relating to the business in connection with which the information was collected. CMC collects personally identifiable information that can be divided into the following categories:

CMC Product Registration Information:CMC Software may ask you for certain personally identifiable information as part of the installation/registration process (including but not limited to your name, email address, credit card information and connection type and number of computers). Certain of this information is necessary in order to conclude the transaction, and for applicable products, to be eligible to receive technical support. If you provide us with personally identifiable information, we use this information to send you communications, including informative emails/newsletters about CMC product upgrades, product updates, new products, services and to provide you with special offers that may be of interest to you. CMC keeps personally identifiable information collected in the course of installation/registration of CMC' products confidential and does not sell, trade or exchange mailing lists with any organization. In the event you no longer wish to receive such information, you may choose to opt out of receiving further communications by complying with the procedures listed in the "Delete/Deactivation Policy" section of this Privacy Policy.

Credit Card Information: If you use a credit card to purchase products via this Site, your name as it appears on the credit card, the credit card number, expiration date and billing address will be encrypted as it passes over the Internet. CMC does not record or keep your credit card information for online credit-card transactions; rather such billing information is stored securely by Charleston Management Centre’s third party billing provider according to local laws and regulations (please see privacy policy at time of purchase). Billing information is only stored in order to comply with local regulations and to provide you with accurate billing information and service. CMC may access such information through the third party billing provider, but does not do so except to process refunds or adjustments and to the extent necessary in the event of non-payment or disputed payments, or as may be necessary for CMC' compliance, in CMC' discretion, with applicable law.

Technical Support: If you request technical support online, we will ask you for information necessary to complete the transaction such as your name, email address and information about your computer hardware, software, and the nature of the problem you are experiencing.

Surveys:CMC may periodically requests information from users via surveys. Participation in these surveys is completely voluntary and you have a choice whether or not to disclose this information. CMC uses a third-party Web-Based Interviewing System to compile the surveys but distributes and administers the surveys internally via our servers. Information requested in the surveys is broad demographic information (such as zip code, age level) for aggregate use and does not identify the user. No cookies are used. Survey information is not sold, shared, or rented to any third party, and is used internally solely by CMC for purposes of improving the use and satisfaction of this Site.

Affiliates: When a user or a company signs up to be a marketing program affiliate, they do so through a third-party provider of affiliate marketing programs. Such third-party provider does share personally identifiable information about affiliates with CMC. This information is not sold, shared, or rented to any third party, and is used internally only to manage and maintain relationships with affiliates.

If you choose to invite a friend to join CMC through a menu option in the software, you will be directed to a web page and will have the possibility of adding one or more email addresses in an online form. Any information entered in this form is stored temporarily and is used only for the purposes of automatically generating an email message to these users. The CMC website may also contain feedback forms where feedback can be reported directly to CMC employees. Any and all information which is voluntarily submitted in such feedback forms are used for the purposes of reviewing this feedback and improving the CMC Software and Services. CMC reserves the right to utilize this information for marketing purposes, for instance by displaying selected comments on its website or in other communications. If CMC chooses to display a user-submitted comment it will either display it anonymously, stripping away all personally identifiable information, or request permission directly from you before displaying it.

No Extraneous System Information Collected

No information concerning your computing facilities is collected that is not related to providing CMC Services, including other installed software systems, non-service-related content, or hardware peripherals. No information about your specific computing facilities will be provided to any third party unless required by the Terms of Agreement of a Service with which you have registered.

Security of Your Information

CMC carefully protects the security of the personal information you provide. Personal information we collect is stored in secured servers with limited access, and we protect this information from loss or misuse, and from unauthorized access, disclosure, alteration, or destruction. Your computer resources can not be accessed by any third party through CMC Software.

Software Installation

CMC Software is installed on computers with an installer downloaded from www.charleston.com.my or other designated web sites. CMC Services may also be provided through other applications that utilize the CMC Software. These applications are required to display the CMC End User License Agreement before the Software is installed. You can uninstall the CMC Software from the standard Windows Control Panel at any time.

Software Updates

The CMC Software contains update functionality. This enables the Software to determine that there is a newer version available, which has improved or new functionality and/or bug fixes. You will be asked for your permission before an update is performed unless you have specifically authorized CMC to automatically update your software without notification. The Software may however update non-program files from time to time without asking the user. These updates are only used to update file indices, configurations and other non-critical objects. These updates only pertain to executable files.

Privacy of Children

No part of our Software and Services is directed to children. We will never knowingly collect information from users under the age of 13.

Links to Other Web Sites

The Site contains links to other Web sites. Please note that when you click on one of these links, you are "clicking" to another Web site. We encourage you to read the privacy policies of these linked sites, as their privacy policies may differ from ours. This Privacy Policy applies solely to information collected by CMC on this Site.

Delete/Deactivation Policy

If you wish to delete any personal Information you submitted to CMC, you may do so by contacting us at admin@charleston.com.my. We will notify you of our receipt of your request. We will use commercially reasonable efforts to functionally delete all such information (excluding any information necessary in order to detect fraudulent use) from our database within fifteen working days from the date of the receipt of your request. Please note that it may be impossible to delete a user’s entry without some residual Information because of backups and records of deletions. CMC reserves the right not to delete information in order to comply with applicable local laws or regulations.

Unless you request that we delete any of the information you submitted to CMC when you registered for any electronic updates and/or newsletters we may offer, we will store such information for a period of two years or for the period of time stipulated in applicable laws and regulations, whichever is greatest. Upon expiration of that time, all such information will be deleted.

Risks and Disclaimers

Please be careful and responsible whenever you are online. If you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return. While we strive to protect your personal information, CMC cannot ensure or warrant the security of any information you transmit to us except for information specifically covered by Intellego’s End User License Agreement or Privacy Policy. The use of CMC Software and Services is done at your own risk.

Our Practice Regarding Cookies

Accounts and Security

Certain areas of the Site (including but not limited to purchase history pages and certain technical support pages) are password restricted to authorized users ("Restricted Areas"). As part of the online technical support requirement, each user will select a password (“Password”) and User Name (“User Name”). You shall provide CMC with accurate, complete, and updated account information. Failure to do so shall constitute a breach of this Terms of Use, which may result in immediate termination of your account.
